Familial status: your rights when you have kids

March 19, 2025

Familial status is protected under fair-housing law. A provider should not use children or pregnancy as a reason to deny housing, impose different rules, or steer a household away from a property. Safety rules should be genuine, written, and applied consistently.

Shared-room and owner-occupied situations can raise additional facts, but a preference for a particular household type is not automatically lawful. Save any listing or message that refers to children, family size, or pregnancy as the reason for a housing decision.

For a specific issue, contact a fair-housing resource promptly.
